My insurance won't cover it because I only have liability since that was all I could afford. I accidentally left the keys in it last night (which this isn't something anyone should have to worry about anyway) so they might even give me a ticket. What am I going to do now? I asked them if they know who stole it and he said
"yeah, we got him" that was about all the info he would give me. but then he said they are going to impound the van for finger printing why do they need to finger print the van if they caught the guy??? doesn't make sense to me. |
How terrible!!! I am so very sorry, what a terrible thing to happen to you!! Be sure to find out if you have to "press charges", you might also want to find out if you have any recourse against him in cival court. If you have proof he stole the van you just might be able to get a judgement against him in cival court. You might not get money from him now but maybe someday. I am so sorry Is there a victims advocacy group in your county to give you advice? |

I don't think you need an attorney to go to small claims court, perhaps Val can give you advice. A judgement there is binding. |
They need to impound it to get the hard evidence that ties the suspect directly to the van. They'll look in specific places for fingerprints that show he was actually in the vehicle and operating it.
I'm not sure what citation the officers can give you for the incident. I'll ask around and get back to you. First thought is that Ohio is a fault state so that's not good for you. There's also a difference if you lock your keys in your car or if it was left unattended and unsecured. Leaving it running while unattended is a whole other thing. (That's bad!) About the insurance, even if you had full coverage they probably would not pay for the damages because you left your keys in the car; it's technically neglect, failure to secure, etc. Nobody leave your keys in your cars. Nothing good can come of it, usually something really bad happens because of it. You can go to small claims court for damages. You do not need an attorney for that. I believe you can also go to the District Attorney and file a claim for theft. You wouldn't recover money for that, you can't profit from criminal activity, you have to do it through civil suit. We do need Val on that part. Keeping our fingers crossed and we'll see what else we can come up with from the legal side. |
I guess I left my keys in the car with the doors unlocked. I usually take the keys in the house but I guess I forgot this time. How could it be that someone steals your car and you get in trouble for it. This just doesn't make any sense to me. Like I wanted someone to steal my car?!
I know there are laws and such but geeez how odd can it get? what next? I have to pay the thieves hospital bills if he is hurt? This just seems out there... I am so lost and confused. Imagine getting woke up and hearing someone stole your car and you are in trouble for it and there is nothing you can do to get another car or money to buy one. |

Wow..I am so sorry to hear that...Chris (my co worker) had his dodge ram truck stolen 2 weeks ago from the back parking lot of the showroom....the door to the back was OPEN...he didnt hear anything, went to leave and thought, hmmmm, i must have parked in front...goes to the front and nothing and realizes that it was stolen...bummer....the cops caught 2 guys...not in the truck, but at a bank were they were trying to forge checks off of a check book that he left in the truck...they still deny the auto theft, but they are now both locked up....they had just been released from jail about a month before.....
He still doesnt have a new truck yet, insurance is taking forever...so I dont have any advice for you, but do want you to know that I am sooo sorry that it happened.... |
Oh, I'm so sorry for your loss. And what frustration you have to go through to get any satisfaction.
We live in a rural area and recently there was an attempted robbery around the corner from us. We were told at that time that if you leave your car IN YOUR OWN DRIVEWAY (and our driveway is about 60' long), if the doors are unlocked and it gets stolen, the insurance companies wouldn't pay for the loss. Amazing. I hope you can get some help soon. |

I got ahold of my lawyer who helped me with an accident a while ago. He should get back to me today with some advice.
The part that really sucks is they won't let me have anything in the car... not the stroller or car seat or my ID or my school books (which I have a final tonight and now can't do much studying for plus so many other things) |

I am so sorry for what you are going through. I hope that all turns out for the best. In Alabama, small claims court does not require an attorney. You represent yourself. I was a defendant a few weeks back for our Company, it really is not all that bad.
When my son and his girlfriend had an accident a month or so ago, they would not let us get anything out of her vehicle either. The only way was to prove that there was full coverage insurance or pay the wrecker and storage bill and have the vehicle moved. I am not sure about Ohio, but in Alabama they can sell the contents of the vehicle to help pay for the towing and storage. I hope that they are holding it at the police station and not the wrecker yard. I am not trying to pour salt in a wound, but you might want to check on that too. It can get expensive very quickly. Here it was $75 for the tow and $25 per day for storage. |

This whole thing stinks! You didn't do anything wrong, and now you
have all this crap to wade through. As for locking or even leaving the keys inside, why does it seem that these things always lean in favor of the criminal? Frustrating!! It shouldn't matter if we leave our cars unlocked or even if we leave the keys in the ignition! A person obviously knows when a car is not his. We are treating the criminals better than law abiding citizens in cases like this. And if a minor was to blame, you may as well forget any recourse. At this point demanding action or trying to speed things up in order to get your things out of the van is probably useless. It is a sit and wait thing now. I am so sorry, it truly stinks! Shellie |
No update yet but I just saw in the paper that there were 2 other vehicles stolen in this town approximatley the same time as mine was. Is that weird or what?? |
