I started working with a really terrific attorney through the Minnesota Attorney Generals Office because I started getting letters from Citi that I was in default and could possibly go thru foreclosure. This woman at Mn Att Gen office was working on it and kept in contact and then I heard nothing. This year, I found out she retired and nobody picked up my file. This past summer, I received more default letters but Citi kept cashing my checks. In June, when I lost my Gracie, I also lost my wallet.When I stated Citi started targeting me, my statements were arriving 6-10 days after the due date and they were taking 2-3 weeks to cash the checks, therefore charging late fees. The first check I sent in June of this year, was not cashed b/4 I closed the account on 6-23, because I lost my checkbook. I sent another check WITH a copy of the original check and statement, (I make copies of my checks and statements to Citi) with a notation to process checks in a more timely manner because it doesn't take 2 weeks for a check to get from Minneapolis, MN to DesMoines, IA. Citi sent a letter stating the were returning my check (the new one) because it didn't cover all of their BS fees. Needless to say, the check WAS NOT included. I sent the July payment and they sent a letter with the same content but actually returned the check. In August, I made 3 separate electronic payments noting 1 for June, July and August. They were accepted. The first part of September, Citi sent me a letter WITH a check in the amount of the 3 electronic payments and informed my I was in Foreclosure and the day after I got the letter and check, I received a letter from a law firm that was handling the foreclosure. Having contacted the Mn Atty Gen Office b/4 this mess, I was assigned a real jerk who has done ABSOLUTELY NOTHING TO HELP!!! Even his supervisor wouldn't return my call. Some very nice people at my bank have been unofficially helping me with Citi. We keep sending Citi all the information they ask for and then they want something else. Citi keeps changing and asking for different information which keeps getting sent. I have proof of all the payments. My bank CANNOT BELIEVE the crap they are pulling. The date for the sale is scheduled for 11/2 @ 9:30 AM. I keep proving I have done nothing wrong and made payments. The Moran @ Atty Gen Off has been absolutely no help. I don't even think he has even looked at all the information I sent. Hopefully my bank people will get this resolved in the next few days. Who knows what else they will come up with!!!!! I have even left messages with news media with no call backs. I am soooooooooo tired of fighting for my home. I grew up in this house and bought it after my Mom passed away. To me this is extortion, grand theft. Citi is trying to STEAL HOME. For what is owed on the mortgage, is a 1/4 or less than the property value. I will lose my equity but mostly MY HOME. Where do I go with my 2 dogs? I CAN'T loose them!!!! Too bad that satellite that fell out of the sky didn't land on Citi and wipe out all of their computers and show everyone who has a mortgage or any account with them paid in full and unable to retrieve the original information. And can you believe, when I was served the papers, the guy pulled up behind my car as I was going into my garage, in the dark and stood inside my garage door until I got out of the car? I was scared and was already reaching for something I could use as a weapon, just in case! |

Have you contacted an attorney? Perhaps there's a way to stop this silliness and sue CitiBank! |

I think you need an in person meeting at the AG's office, and your own attorney. I'm so sorry you're going through this. I wonder if you could find the woman who was helping you before she retired? I bet she would at least be able to offer some guidance of what to do. |

dogmom, you need an attorney pronto to help you. it will, at the very least put this off for quite some time and hopefully you'll be able to verify through him/her that you made your payments in a timely fashion. |

I spoke with my person at my bank this am, who is unofficially helping me with Citi Mortgage. Evidently Citi has diverted a number of my payments to a bankrupcey account. Diverting money to me sounds illegal. Supposeidly this should be resolved in a day or two. I wish I could afford an attorney because I would love to sue Citi. My bank guy told Citi they are to send letters to the credit bureau, the court etc and state this problem was Citi's fault, not mine, and never to do anything to my account again. I also will follow up with my state senators, Citi needs to be investigated for these practices and I am sure other lenders are victimizing homeowners. I am NOT going to be their victim ever again! I also thing the MN State Attorney Generals Office should be investigating and investigated. Also, none of the news medias seem interested in this story. Oh well..................I'm not letting go of this. I think BITCH is a really good word. |
That's terrible what they are doing to you! Does your state have a mediation program? Have you considered contacting legal aid for some help? They could advise you how to get into the mediation program if applicable and help to protect you. If you've received an NOS that's serious business. If you can still continue to find other sources of help besides your "unofficial bankers" probably a good idea to be on the safe side to indeed make sure that the sale is stopped. And good idea to contact your congressman and senators as well, sometimes they have a special phone number to deal with the banks. If legal aid could help you to find a real estate attorney that would be a good idea. Do you have contact with any REALTORS? They may be able to recommend a real estate attorney that's known to be having success dealing with this particular type of situation and could possibly arrange for you to have a free consultation. I know how angry and how upset and frightened this must make you. It makes me furious just to read about it. I do have a suggestion that I hope won't offend you. I think it is important that whenever you are dealing with anyone official: lawyer, realtor, legislator, bureaucrat at the Attorney General's office, anyone official, especially if you are asking for their assistance: be very polite, very clear, and as concise as possible. This is true whether you are writing letters, emails or making phone calls. If you are talking with someone that you know you might have been too emotional with on a previous occasion, apologize for having let your emotions get the better of you, and thank them for their patience. Even if they haven't been patient. If you talk with someone, please open by thanking them for taking time to speak with you. You can always say, early on that you realize your emotions may run a bit high but that you aren't angry with (the person you are talking with) but at the situation. If I were in your situation, I would have to have it scripted for me: it would be too easy to get off track or to get upset and deviate from the clear, concise, and very polite message/request for aid. Same thing for anything written, even an email. Close with a thank you for their time. For phone calls, follow up THAT DAY with a short note, thanking them for their time. I find that a paper trail is often much more effective than a phone call. Sometimes, a fax will do, but a paper trail is really, really helpful because it documents your request the way that a phone log of your phone calls will not (but still: keep a log of phone calls, including name of person you spoke with, their position if possible, date/time). If they ask for documentation, have it on hand and send it immediately upon request. Remember: you want to be exceptionally polite, clear, respectful (even if they aren't being that way to you). People really do stop listening if there's too much emotion involved, and especially if they feel they are being criticized or blamed. Vent here as much as you need to. But when dealing with those whose job it is to help you, you must, for your own sake, be as professional and polite as possible. NEVER give up. |
