Looking for OES Models!

Hello!
I'm currently looking for some OES models. You will be compensated for the photo you provide if it is used in my 2009 portfolio.

What I'm looking for:
Agility - OES w/tire or tunnel
Multiple OES - Folk Art Bathtub Scene
Multiple OES - Groomer's Sign
Cartoon -

I'm not discriminatory as I use all OES in my work!! Does NOT, I repeat, DOES NOT have to be a show OES by any means!!

If you are interested, please feel free to contact me.

Thank you!

Michelina~

What are the legalities of using a professional photo to work off of? I have a number of tire and tunnel pics, but all taken by professionals.

Just curious.

Kristine
I would need written consent from the photographer that has the actual letterhead from the studio IF these photos have a copyright on them (which most of them do). It would have to be an original document and have to be signed by the photographer.

I do not accept any photographs that have a copyright on them unless I have written consent from another Artist/Photographer.

Michelina~
Got it.

I'm sure all of mine are copyrighted but who can remember what was taken by whom at this point. I'm sure others have more casual pics you can use.

Kristine 8)
Casual is fine. 8) I know Agility isn't all that popular in these parts....lol I've only hand painted 2 jackets in 4 years with an OES going through a tire. The one woman didn't want that design advertised on my site because she didn't want anyone else to have one like hers....hahaha!!

It happens

OES in agility probably aren't widespread anywhere, actually, but the number one agility OES in the county for years finished her two Master Agility Championships in your part of the world (Florida) And I feel as the person you described would: why would I want a depiction of some generic OES doing agility when mine are among the maybe 10 or so in a given year who actually do so competitively? 8O

As gorgeous as an OES in full coat going through the tire is, because there are so few OES involved in the sport, I can't see that there would be a big market except by commission. Lounging upside down on couches is probably more representative of the general population so more apt to have a market

When I first started an artist up this way had used a painting of a friend's agility OES to make mousepads and I bought one of those precisely because I knew the bitch and could say, hey! That's Yoda! In fact, that was in '01, but I still have it.

On the flip side it's nice to know someone does things along this line the next time I'm in the position of trying to figure out what to do for trophies... :lmt:

Kristine
i am teaching agility every sat morning feel free to stop by if you are in cocoa..

Michelina,

On the multiple ones, like in a bathtub, do you actually want them in a bathtub? Or is that something you plan to paint around them. I'm pretty sure I can't get both OES into our tub at the same time, lol.

That's the one!!!!!!!

It's CLASSIC!!!

Nice work, dude!

KB :D
Hahaha!! That's a great photo!! Love it.

As far as the bathtub scene, I literally just need chest and head shots of the OES itself. I intergrate the likeness of the OES into a scene. So it can be a few OES from different owners, or I might like all from the same owner. It's more of markings and head gestures because I want it to have a personality.

Thank you for your interest!!

IF these photos have a copyright on them

Be careful. Pictures are copyrighted the moment they are put in a tangible format. They only need to be registered with the Library of Congress if you intend to sue in federal court for monetary damages.

When is my work protected?
Your work is under copyright protection the moment it is created and fixed in a tangible form that it is perceptible either directly or with the aid of a machine or device.

Do I have to register with your office to be protected?
No. In general, registration is voluntary. Copyright exists from the moment the work is created. You will have to register, however, if you wish to bring a lawsuit for infringement of a U.S. work. See Circular 1, Copyright Basics, section “Copyright Registration.”

Why should I register my work if copyright protection is automatic?
Registration is recommended for a number of reasons. Many choose to register their works because they wish to have the facts of their copyright on the public record and have a certificate of registration. Registered works may be eligible for statutory damages and attorney's fees in successful litigation. Finally, if registration occurs within 5 years of publication, it is considered prima facie evidence in a court of law. See Circular 1, Copyright Basics, section “Copyright Registration” and Circular 38b, Highlights of Copyright Amendments Contained in the Uruguay Round Agreements Act (URAA), on non-U.S. works.

I take pictures for a living and over the past 5 years? have had businesses, manufacturer's and individuals steal my work and use it to compete against me...
Nice!!! :clappurple: And it's quite similar with music as well....oh yeah, and literature too!

I do know that whole process and it's a double edged sword I'm afraid.
I'm sorry that happened to you.

Oh, I know YOU know
I wish Shamu would let me take her picture :( She is so beautiful but in all her pictures I have to catch her off guard or hold on to her.
I don't know what to do to correct that 8O
I can't wait to see your finished products

You rock. Thanks for posting this. I too made my living with a lens and still have a number of pieces in stock libraries. I saw my first piece of stolen work/copyright violation by a corporation in 1982. It is an awful feeling of violation. *hugs*.... you have my best wishes.

So you too know what it's like.

I just can't believe some of the ignorance out there. A couple of nights ago I found yet another small retailer has taken my pictures and is using them to sell the same items. Some pictures still have my initials on them, others have had my initials erased... one has a mfr. watermark over it. The mfr. indicated in the watermark has stolen 49 of my images and states on their website they'll supply my pictures (without "their" watermark) to people who purchase the product.

This has happened in the past with businesses large and small... one was a chain store. My pictures enabled one small eBay business to sell a minimum of $6,000 worth of merchandise (that's as far as I could track it before listing details were removed) before I pursued a DMCA takedown. eBay immediately shut down all current auctions where infringing images were displayed.

It can't just be ignored or it spreads.
Jaci, I just sent a PM.
Got it... replying now
