We can fix the car - Merry CHristmas to us but I really think we should persue trying to get this kid and his parents to pay. Sorry Ineeded to vent to someone. |

I don't know what Florida law is but in NY it is a crime to drive without insurance. I would certainly pursue legal avenues to "persuade" the person to pay. |

In MI we have the uninsured motorists fund, it's funded by those who have insurance. Maybe FL has it as well and will cover the repairs. I'm glad your daughter wasn't hurt but tell her to watch for pain or stiffness in her neck and back, common in rear end crashes that may not show up immediately. |

Thanks I talked to Jess today and she said she feels like a bus ran her over. she is on pain meds and muscle relaxers - she went to the school health center yesterday after the accident because she did have neck pain.
The car repairs are less than $5,000 and we will pay and then try to get something out of small claims court - I am concerned about her injuries though since she graduates in April and goes off our health insurance . None of the lawyers I talked to offered much hope - however the kid is in ROTC and I am sure his CO will have something to say about it - I have been told that that is a good course of action to take to try to get some satisfaction out of it. Today Jess was sobbing on the phone - as only self centerd coillege/graduate students can - about how come she should have to pay for it, she didn't do anything wrong etc etc. I guess it is a good life lesson for her. There will have to be something extra special under the Christmas tree for her this year |

The uninsured motorist fund is not for the "physical" coverage of the car. The car's Physical coverage is under Collision. |
I would get an estamate for damages and then talk to the girl and her parents and if they don't pay for the damage take it to small claims court or whichever court will handle it. (it depends on the amount of damage claimed) |
Jess called the guy who hit her and he says he is willing to pay for the damage to the back of th ecar where he hit her - not the front where he pushed her into the other car. I do believe we will be going to small claims court. what a bother with the holidays and trying to do it all long distance - guess I may be going to florida for a quick trip after all, |

we had the same problem here in WI....finally the DOT got involved and they took care of the whole thing....if the uninsured did not pay...then his driver liscense would be taken away...he ended up making payments until all was paid....good luck |
Tell her it ok to be whiney about how she did nothing wrong and is the one who has to pay. I got hit be a uninsured driver at few years ago, boy was I a pain about it. I did have collision, my insurance company was good about the whole thing. I never got money from him, but when he ran the light and I t-bones him, I spang his car frame. I think that military drivers are required to have insurance no matter the state law. I do not work for the military any more or I would check it out for you. |
Yes military drivers are required to have insurance too. There are no exemptions for not having insurance.
You should definitely pursue this, as this individual can be made to pay for the damages as well as be punished for this act. We were hit by an unisured driver once and he promised to pay and we took him to court. The court said that since he promised to pay we should send him a registered letter so that there was a paper trail. Well, he refused the letter and dropped off the radar. Take paperwork with you and he can sign it in front of the judge! |
